Litigation

The firm represents clients locally, regionally, and nationwide in dispute resolution.  Areas of litigation practice include disputes involving contracts, real estate and construction, business and banking, probate (including will contests and antenuptial agreements), personal injury and product liability, civil rights, harassment, discrimination and employment, professional malpractice, and intellectual property.  Criminal Defense matters, including White Collar Criminal Defense, and the defense of juvenile delinquency complaints, are handled by experienced former prosecutors.

Cohen, Todd, Kite & Stanford, LLC believes litigation is expensive and should be a last resort for the resolution of disputes.  However, in cases where trial is inevitable, the firm's attorneys are prepared to aggressively represent each client's best interest through discovery, trial, and appeals.

Recent litigation and dispute resolution activity by the firm's attorneys include the following matters:
  • Construction defect litigation involving engineering and construction management firms;
  • Geotechnical failures;
  • Damages allocation for class members in the ACC-“Keating” litigation in Arizona;
  • Successful defense of a grand jury criminal investigation of alleged price-fixing, conducted by the U.S. Department of Justice, Antitrust Division;
  • Personal injury, malpractice, and wrongful death;
  • Specific performance of a real estate contract;
  • Lost profit claims under a cancelled supply contract;
  • Driving under the influence, antitrust, pollution, embezzlement, and other criminal matters; and
  • Acting as court-appointed trustee for a multi-million dollar settlement fund.
